  1. Scope of Agreement
    These Terms of Service (the “Agreement”) govern the provision of internet access services (the “Service”) by EvolvingDesk Kft to the Customer. By placing an order, activating the Service, or using the Service, the Customer confirms acceptance of this Agreement.

  2. Eligibility
    The Service is available to individuals aged 18 years or older with a residential or business address in Hungary. The Customer must provide accurate and complete information. The Provider reserves the right to refuse or cancel any order without stating reasons.

  3. Contract Duration
    The minimum contract term is twenty four (24) months from the activation date. After the initial term, the Agreement continues indefinitely and may be terminated by the Customer with one (1) month notice. Early termination by the Customer is not permitted. In case of early termination, all remaining monthly fees for the full contract term become immediately due. The Provider reserves the right to terminate the Agreement at any time for operational, technical, or commercial reasons. Where possible, a notice period of fourteen (14) days will be given.

  4. Service Provision
    The Service may be delivered via a fixed wired connection, or a wireless mobile network, including 4G or 5G, depending on availability at the Customer’s address. The Provider reserves the right to determine the most suitable delivery method.

  5. Installation and Delivery
    The Service may be provided in one of the following ways: installation by an appointed technician, or self installation using pre configured equipment delivered to the Customer. Where equipment is shipped, delivery is carried out via a courier selected by the Provider. The Customer is responsible for proper installation and use of the equipment in case of self installation. Risk of loss transfers to the Customer upon confirmed delivery.

  6. Mobile Network Services
    Where the Service is provided via a mobile network, the Customer acknowledges that performance, including speed and latency, may vary. Performance depends on signal strength, network load, and environmental conditions. The Service is provided on a best effort basis. No minimum speeds or uninterrupted availability are guaranteed. The Provider is not responsible for performance limitations caused by third party mobile networks.

  7. Equipment and SIM Usage
    All equipment provided by the Provider, including routers and SIM or eSIM cards, remains the property of EvolvingDesk Kft at all times.
    The Customer agrees:
    a) not to open, modify, or tamper with the equipment
    b) not to reset or reconfigure the device without written permission from the Provider
    c) not to remove, replace, or use the SIM or eSIM in any other device
    d) not to use the equipment for any purpose other than the provided Service
    Upon termination, all equipment must be returned within fourteen (14) days. In case of non return, loss, or damage, a replacement fee of up to EUR 300 will be charged.

  8. Fees and Payment
    All fees are stated in euros (EUR) and include VAT unless stated otherwise. Subscriptions are billed monthly in advance and collected automatically via the selected payment method.

  9. Late Payments and Suspension
    If payment fails, a first reminder is sent after three (3) days. A second reminder is sent after ten (10) days. Service may be suspended after fifteen (15) days. Reactivation may incur a fee equal to one monthly subscription. Persistent non payment may result in termination and collection procedures.

  10. Acceptable Use
    The Service is intended for lawful and reasonable use. The following is prohibited: illegal activities, resale of the Service, and network abuse including spam or attacks. The Provider may restrict or suspend service in case of abuse.

  11. Service Interruptions
    The Provider does not guarantee uninterrupted Service. Interruptions may occur due to maintenance, network issues, or external factors. No compensation is provided for service interruptions.

  12. Liability
    The Provider is not liable for indirect or consequential damages, including loss of data or income. Total liability is limited to the amount paid by the Customer in the previous twelve (12) months.

  13. Amendments
    The Provider may update these Terms at any time. The latest version will be published on the website. Continued use of the Service constitutes acceptance of changes.

  14. Governing Law
    This Agreement is governed by the laws of Hungary. Disputes shall be handled by the competent courts in Hungary.

  15. Acceptance
    Acceptance of these Terms is required for Service activation. Orders placed by the Customer do not guarantee acceptance by the Provider. The Provider reserves the right to adjust service parameters, including connection type, speed, or delivery method, based on availability.
